Motions To Reconsider & Reopen

Motions can be done for two different reasons. The first is that there has been a change in circumstances since the original denial. An example might be pending criminal charges being the reason for a denial, but the applicant having been acquitted or seen the charges dropped. Motions filed on these grounds are called a motion to reopen.

The second kind of motion is when there has been an error in how an immigration official applied the relevant law.  Motions for this reason are called a motion to reconsider

Both kinds of motions use the I-290 B Form and are filed with the Administrative Appeals Office (AAO). 

What An Appeal Can’t Do

It’s common for there to be a certain amount of gray area in an application, situations that don’t lend themselves to an automatic legal answer. In these situations, officials at U.S. Citizenship & Immigration Services (USCIS) are given a certain amount of discretion in whether they approve or disapprove an application. 

An applicant who has been denied cannot seek an appeal simply to get a different person to hear the same case. The reasons for use of the I-290B form either presume new facts coming into evidence since the original hearing, or errors made in areas where officials don’t have discretion. 

This distinction is important, because an attorney must be knowledgeable in the issues that can make up a successful motion, and skilled at presenting those reasons to the AAO.
