Who Can Be Sponsored Under Form I-130
The relationship between petitioner and beneficiary determines both eligibility and how long the process takes. U.S. citizens can sponsor immediate relatives, which includes spouses, unmarried children under 21, and parents. The immediate relative category carries no annual visa cap, so these petitions often move faster than others once approved.
Lawful permanent residents can sponsor spouses and unmarried children, but those relationships fall into family preference categories subject to annual numerical limits. Wait times in preference categories can stretch from several years to well over a decade depending on the applicant’s country of birth and which category applies. Green card holders can’t petition for their parents. That option becomes available after naturalizing as a U.S. citizen.
Every petitioner must also demonstrate the financial ability to support the incoming relative. Form I-864, Affidavit of Support, is a legally enforceable contract with the U.S. government. The sponsor’s obligation generally continues until the sponsored relative becomes a U.S. citizen or accumulates 40 qualifying quarters of work, typically around 10 years.

The current USCIS filing fee is $625 when filed online or $675 by paper. That fee is non-refundable and doesn’t cover adjustment of status or consular processing fees, which come later. Fees are subject to change, so we confirm current amounts before any client submits.
Relatives already in the United States file Form I-485 to apply for adjustment of status, either concurrently with the I-130 for immediate relatives or after approval. Relatives outside the United States proceed through consular processing at a U.S. embassy or consulate.
